German support for Merkel's crisis handling erodes: poll

BERLIN (Reuters) - Only one third of Germans still believe Angela Merkel is making the right decisions over the euro zone debt crisis, according to a survey published on Sunday, pointing to a steep erosion in domestic support for the chancellor over the last weeks.

The survey by YouGov, due to be printed in Monday's edition of Bild newspaper, found 33 percent in favor of her stance but 48 percent against, a setback for the chancellor who is to seek a third term in a 2013 federal election, which she has vowed to make a vote on Europe.

Asked in the survey whether they feared for their savings, 44 percent of Germans said that they did.

In mid-July, a poll by ZDF-Politbarometer showed 63 percent of Germans backed Merkel's handling of the crisis, although a majority thought she should explain her policies better.

Another poll at the start of July by Infratest-ARD put support for Merkel's crisis policies at 58 percent, although 85 percent of those polled also expected the crisis to get worse.

Merkel's tough stance on the crisis and demands for austerity in exchange for aid have seen her demonized across Europe, but earnt her popularity at home.

The euro zone entered a threatening new phase in the last weeks, however, as concern rose Greece would be unable to meet its bailout conditions and Spanish and Italian assets came under renewed market attack, stirring fears about the rising cost of Europe's debt crisis for German tax payers.

Last week Moody's Investors Service changed its outlook for Germany, the Netherlands and Luxembourg to negative from stable as Germany might have to increase its support for troubled states.

Philippine gunmakers take aim in election year

In the Philippines, they vote with their trigger fingers. Elections mean big business for illegal gunsmiths, who are looking forward to 2013 mid-term polls.

With election-related violence commonplace, the Philippines imposes a ban on the carrying of guns for six months, from campaigning to the proclamation of winners.

With legal access denied, Filipinos simply turn to the many illegal gunsmiths who ply their trade in back alleys and on the edge of rice fields despite government crackdowns.

In Danao City, in the northeast of central Cebu island, they are already anticipating a windfall.

"There's actually huge demand for guns, especially now and because of the elections next year," said a 33-year-old gunsmith, who asked to be named only as Remo, as he hammered away at bits of scrap metal in a makeshift factory in Danao.

Loud music drowned out the noise of Remo's workshop on the edge of a dry creek, hidden from view by thick bamboo groves, as he and two assistants hammered, filed and drilled away.

"We are actually having some difficulty in keeping up with the orders because it usually takes at least two weeks to make one .45 caliber pistol, even if I work 16 hours a day," he said.

Legal industry
As the pro- and anti-gun lobbies in the United States agonize over how to respond to yet another massacre of innocents, in the Philippines many want even more liberal gun laws to boost production of a small but growing legal industry.

Guns have long been part of everyday life in the Philippines, especially since the end of World War Two.

After the war, farmers took up arms during agrarian unrest in the late 1940s and early 1950s and then a Maoist insurgency that has become one of the world's longest-running conflicts.

Today, all private security guards in the Philippines carry either handguns or shotguns, or both. Guns are a common sight in shopping malls, government and private offices, banks, restaurants and even schools.

"When we were children, we were already surrounded by guns. It was the world of our fathers," said Elmer Genzon, a third-generation gunsmith who once made "paltik", or illegal weapons, out of scrap metal and bits of angle iron.

"We grew up making guns."

According to www.gunpolicy.org, a site hosted by the University of Sydney's School of Public Health in Australia, there are about 3.9 million guns -- legal and illegal -- held by civilians in the Philippines, or about 4.7 per 100 people.

That puts the Philippines 105th place on a list of 179 countries, tiny in comparison to the 88.8 per 100 in the United States and behind even Australia with 15 per 100.

While it is impossible to count the number of illegal guns in the Philippines, the national police estimate there are about 350,000, again paltry in comparative terms to Central and South American weapons hotspots like Guatemala, Honduras and Colombia.

Yet the Philippines suffers worryingly high gun-crime rates.

According to the latest available figures from the U.N. Office on Drugs and Crime, there were 8.9 homicides per 100,000 people in 2003, by far the worst in Asia and outstripping Europe.

While not at the levels of Central and South America, the number was still almost triple that of the United States, which had 3.3 homicides per 100,000 people the same year.

Illegal guns are not just carried by criminal gangs, Maoist rebels and Muslim separatists. They also belong to civilians and politicians who keep private armies.

Investigations into the Ampatuan family, a political clan linked to the 2009 massacre of 57 people, including dozens of journalists, found more than 1,000 high-powered weapons, including mortars and .50 caliber machineguns.

Health plan
In the 2004 elections, authorities decided to crack down on illegal gunsmiths in Cebu. There had been more desultory attempts to act against an industry dating back to the early 1900s.

Police closed the Genzon family's home factory on the edge of a rice field during the 2004 crackdown.

Like other gunsmiths from his hometown, he was soon working at the government-registered Shooters' Arms Manufacturing factory about 25 km (15 miles) down the road in Mandaue City.

"We no longer have to worry about police raids and we also have a steady source of income, plus some health and other social benefits," Genzon, 33, told Reuters while he wrapped a handcrafted model of a 1911 Colt .45 destined for a dealer in Rochester, New York.

A small army of 400 workers assembles revolvers and pistols at the Mandaue factory, which exports guns to the United States, Australia, Italy and Thailand.

Factory owner Romulo de Leon III, a second-generation gun dealer, quickly recognized the unusual skills developed by the illegal, backyard gunsmiths when he decided to switch from selling imported weapons to making his own.

His partly automated factory now produces about 20,000 guns a year, with up to 85 percent of them sold abroad, making him the second largest gun manufacturer in the Philippines.

With cheap labor and Filipino ingenuity, de Leon wants to expand into new markets in Eastern Europe and South America.

With more foreign markets in their gunsights, legal manufacturers hope President Benigno Aquino, a gun enthusiast who shoots competitively, will help liberalize gun laws.

"What we want is a more balanced gun legislation, not too restrictive, but we also understand that guns must be regulated," said Demetrio Tuason, head of the largest and oldest manufacturer in the Philippines, Armscor, at a Manila gun show.

Existing laws allow Filipinos to own one "long" firearm -- a rifle or shotgun -- and one handgun. Guns are meant to be licensed and owners must have permits to carry them in public.

Tuason wants gun licenses more like driving licenses, allowing people to "own as many guns as they can afford".

Not surprisingly, gun sellers also want to expand the industry, worth about 2.5 billion pesos ($59.37 million). Export receipts grew fourfold to $23.4 million between 2000-11.

But, just like in the United States, there seems little appetite to change existing laws. "That's not a priority right now," Aquino told Reuters in an interview earlier this month.

There are 34 gun-related bills before both houses of parliament, some seeking looser laws and others more control.

Supporters of two prominent bills seeking to outlaw civilians carrying guns in public and stiffer penalties for possession of illegal weapons have all but given up hope.

Much like the United States, guns are so deeply ingrained in Philippines culture that they don't expect the July 20 shooting in a Colorado cinema, in which 12 people were killed and 58 wounded, will have much of an impact.

"For the last 22 years we've been telling our lawmakers ... to pass a strict gun control law but nothing has happened," said Nandy Pacheco of the Gunless Society group.

"Our gun laws are encouraging a culture of guns, a culture of violence. When do we act? Are we waiting for a similar attack to happen here in our movie houses?"

Nick Diaz Update: Will Return, Wants Anderson Silva

Like a passing case of the munchies, UFC welterweight contender Nick Diaz's plans to retire seem to have faded, and taking the place of that retirement is a burning desire to face UFC middleweight champ Anderson Silva.? All this is according to his longtime coach, Cesar Gracie, who posted a lengthy statement on the matter over at GracieFighter.

It was only just February when Diaz purportedly turned his back on the sport, a move prompted by his controversial unanimous decision loss to Carlos Condit at UFC 143.??The defeat?came?after a five-round scrap for the UFC Interim Welterweight Championship title, and the bout?saw Condit playing "hit and run" while the Stockton native followed him around and?hurled insults.? Soon after,?it was revealed that?Diaz had tested positive for?marijuana metabolites in a post-fight urinalysis, and the subsequent year-long suspension levied upon him appeared to be the icing on the retirement cake.

Said Gracie:

For the last couple months I've watched Nick begin to frequent the gym more and more.? He's training harder now than he has for many of his fights.? It was obvious that training and fighting is in his DNA.? It is who he is.

This week we had a great talk and he made it clear to me that he is ready to get back in the cage.? Nick Diaz will return.

With interim champ Condit destined to face UFC welterweight champ Georges St. Pierre at UFC 154 in November, who is there for Diaz - an elite,?top-level fighter -?to face that's worthwhile?

As far as future opponents, Nick has stated that he would like to take fights "that matter".? Since GSP will be fighting Condit, he has to look elsewhere.? He will respectfully ask for a fight with Anderson Silva, a fighter he respects and would like to challenge.

Silva's camp has been speaking of a fight with GSP, possibly even at a catchweight.? Nick will take that fight in a minute but has told me that should Silva decide not to drop at all, he will move up to 185lbs to face the Champ.

And there you have it.? Unfortunately, unless Diaz (or, more aptly, his attorneys) can figure out a way around his suspension, ain't nothin' going down 'till February, 2013.? Remember kids, dope is for dopes.? Don't be a dope!

Jim Genia tweets here and wrote this book.? Come at me, bro.

Malick and De Palma in competition at Venice film festival

ROME (Reuters) - Terence Malick's "To the Wonder" starring Ben Affleck and Rachel Weisz and Brian De Palma's "Passion" with Rachel McAdams and Noomi Rapace are among the films in competition at this year's Venice Film Festival, organizers said on Thursday.

A slimmed-down lineup of 18 films will be competing for the Golden Lion award at the 69th edition of the world's oldest film festival, which runs from August 29 to Sept 8.

Malick, winner of the Cannes film festival's Golden Palm award for his epic "The Tree of Life" in 2011, brings a romantic story of refound love to the Lido, while veteran U.S. director De Palma's "Passion" is a murderous tale of revenge.

Other films in the Competition section include Harmony Korine's "Spring Breakers" starring James Franco, Selena Gomez and Vanessa Hudgens, Ramin Bahrani's "At Any Price" with Zac Efron and Dennis Quaid and Takeshi Kitano's latest offer "Outrage Beyond".

Only 17 films were announced at a news conference in Rome on Friday but the 18th entrant will be announced later.

Artistic director Alberto Barbera promised a "more sober, less glitzy" event for the 69th edition. "I had promised to reduce the number of films and I've kept that promise, more or less, apart from a few small exceptions," he said.

Mira Nair's thriller "The Reluctant Fundamentalist", about the conflict of loyalties facing a young Pakistani man working on Wall Street, will open the festival.

Spike Lee's "Bad 25", a documentary about the late Michael Jackson and Robert Redford's "The Company You Keep", with Julie Christie, are among films showing outside the main competition.

Are Social Media Signals a Google Ranking Factor?

This video was released almost 2 years ago in Dec 2010.? Fast-forward now to July 2012 and it?s pretty clear Google is now using social signals as a pretty big ranking factor.?? But more importantly the take away here is not just any old social signals, but they are looking at authorship trust on social accounts.

Matt Cutts: ?In the same way that page rank depends on not just the number of links, but the quality of those links, you have to think about, what are the followers who mean quality? You know, who are the people who actually are not just bots, you know, or some software program, or things like that??

Machine Learning

This basically means, not all Tweets or Facebook mentions are created equal.? I think Google has been working with algorithms that are machine learning. The algorithms can now tell (very well) the difference between ?real? social accounts/authors vs spam accounts. Can it detect all spam? No.? But the algorithms have only gotten better over time and now that they are using machine learning technology it?s only going to become more accurate.? We seen the power of it with understanding the quality of backlinks (Penguin Update) and on-page content (Panda Update). ? Just look at this video and the things you can do if you want to connect to their prediction API.?? And now with that their entire product based is and has been coded to tie into their new social network Google+ proves that social signals are not going away in search.?? In fact, it will be deeply integrated.

What Should a Small Business Do With This Information?

Get social! If you do not have Twitter, Facebook, LinkedIN, Google+, & Pinterest accounts set-up yet, then get it done ASAP.? Then start participating.? It?s not hard once you get their a bit.? Social media marketing is just like networking at ?live? event/conference.? Treat people like humans, be helpful, & participate in the conversions.?? Essentially, be social.??

The goal is to develop social friends and an audience/followers.?? The more quality followers you have the more opportunities you have to send targeted traffic/links/mentions back to your website.

Are You Participating in Social Media Marketing?

Tell us in the comment section below.? Are you participating in social media marketing??? If so, let us know what you are doing and your success stories.? If not, let us know what your questions are about social media marketing and we?ll answer them.

Low Impact Cardio For The Maximum Fitness | Technology Reviews

Add strengthening exercises to your fitness plan to build muscles that burn calories. You don?t have to hit the gym and lift heavy weights to build muscles, and in fact many simple strengthening exercises can be done at home. You can easily mix push-ups and squats into your routine to tone muscles and increase your metabolism.

Maintaining your fitness throughout the winter months can be challenging. It?s easy to lose momentum. This is a good time to buddy up with a friend, coworker, or family member so that you can stay active and be fit throughout the cool temperatures. You could try to find a gym that offers lots of classes during the winter.

To keep fit when you go out, park far away from the location you are trying to get to. For example, at the mall, instead of fighting for the closest parking space, park out in the distance. The walking will help you keep your metabolism up and burn calories.

A good nutritional tip is to keep eating healthy even when you?re trying to put on muscle. A lot of people think they can eat whatever they want when they try to gain muscle, but that kind of reckless eating will only result in fat gain. Instead, keep eating healthy as you normally would.

Depending upon the type of fitness routine you are following, you may need to make adjustments in the type of foods and drinks you consume, as well as the time that you consume them. If you are doing cardio exercises, do not eat immediately after your regimen. Wait until your body feels like your pre-workout levels to avoid indigestion and stomach upset.

Remain dedicated to your fitness program by signing up with a friend or partner to run or walk for a charity-sponsored event. It can be very empowering and motivating to know that you are working toward a cause that is both good for society as well as good for your body and appearance.

Make sure that you get the most out of your shoulder workouts. There are three parts that make up your deltoids and ideally, you want to hit all three, if you want a well developed muscle. Shoulder presses and lateral raises, are two of the best exercises you can do.

When you begin a new fitness program remember that muscle mass is not the only factor involved. Many people think that increasing their muscle mass is the key to becoming fit when in reality decreasing your overall body fat content is far more important. Many people do not have the genetics to have a high amount of muscle, but a high body fat index does far more harm.

The most important thing when it comes to your fitness goals is to remain patient and committed. Weight doesn?t come off like magic, but the health benefits of fitness are worth the effort. By applying the tips and advice from this article, you stand the best chance of reaching and maintaining your fitness goals.

(AP) ? Stocks soared in the U.S. and Europe Thursday after the European Central Bank president vowed to "do whatever it takes" to keep the continent's monetary union intact.

The Dow Jones industrial average jumped 211 points, or 1.7 percent, to 12,887 as of 3:20 p.m., following European markets sharply higher. Benchmark stock indexes surged 6 percent in Spain and Italy and 4 percent in France.

The comments from Mario Draghi at an investor conference at the Olympics raised hopes that Europe's central bank might intervene in markets to bring down the cripplingly high borrowing costs for financially strapped European countries like Spain and Italy.

After insisting for months that it was up to European governments to restore confidence in the currency shared by 17 nations there, Draghi pledged that "The ECB is ready to do whatever it takes to preserve the euro."

A commitment of that sort is a big boost to global markets because "the No. 1 problem in the world now is Europe's finances," said John Fox, director of research at Fenimore Asset Management. "When the head of the ECB comes out and says he's willing to do anything, that's code for 'We are going to agree to resolve this issue.' "

In other signs that investors were becoming more confident that Europe's financial crisis would not spin out of control, borrowing costs for Spain and Italy fell sharply, the euro surged a penny to $1.23 against the dollar and the yield on the 10-year Treasury note rose to 1.43 percent from 1.40 percent late Wednesday. Investors tend to sell low-risk assets like Treasurys when they're less fearful about global markets and the economy.

"Close to 20 percent of the S&P 500 companies' revenues comes from Europe," said Lawrence Creatura, portfolio manager at Federated Investors. "We're in a global, interconnected economy and Europe's troubles are our own today."

The broader the Standard & Poor's 500 index rose for the first time in five days. It was up 20 points to 1,359 on the European news. The gains in the U.S. stock market were broad. All 10 of the industry groups in the S&P 500 index rose, led by telecommunications companies.

In other trading, and the Nasdaq composite index rose 36 points to 2,890, despite more disappointing news from technology companies including the online game maker Zynga.

Several U.S. companies were also rising sharply after reporting stronger earnings. Sprint Nextel jumped 67 cents, or 20 percent, to $4.04. The country's third-largest wireless carrier was successful in convincing smartphone subscribers to pay up for "unlimited data" service, and its service revenue zoomed higher, beating analysts' estimates.

In Europe, Draghi's comments came after days of uncertainty in Europe and rising concern over Spain's recession and the country's banks, which are reeling following the implosion of a real estate bubble. As borrowing costs for both Spain and Italy rose in the past week, investors feared that both countries might need to be rescued, as Greece, Portugal and Ireland have been. .

Borrowing costs for Spain's government plunged following Draghi's comments as investors anticipated that the European Central Bank might step up its purchases of Spanish government bonds.

The yield on Spain's benchmark 10-year bond dropped almost half a percentage point, an enormous move, to 6.89 percent. That rate surged as high as 7.54 percent this week as investors dumped the country's bonds and lost confidence in Spain's ability to manage its debts.

Technology companies continued to report disappointing earnings following industry leader Apple's rare earnings disappointment earlier this week.

Zynga, which produces popular social network games "CityVille" and "FarmVille" posted poor quarterly results and cut its outlook, prompting a number of analyst downgrades. Its stock fell $1.97, or 39 percent, to $3.10.

The news also dragged down shares of Facebook, which got about 12 percent of its 2011 revenue from Zynga. The poor results may hurt Facebook's second-quarter revenue when it reports its own quarterly results later Thursday. Facebook fell $2.07, or 7 percent, to $27.27.

Among other stocks that were making big moves were:

? PulteGroup gained $1.77, or 18 percent, to $11.79 after the homebuilder posted a quarterly profit, beating Wall Street's forecasts thanks to higher house prices and sales.

? United Continental slumped $1.26, 6 percent, $19.15 after the combined airline's second-quarter net income dropped 37 percent as it continued to wrestle with merger-related issues.

? Whole Foods Market jumped $8.80, or 10 percent, to $93.33 after the natural and organic foods store chain lifted its profit outlook for the year. Its net income jumped 32 percent in the latest quarter as shoppers spent more.

Comment: A case for 'institutional reforms' in the ... - Minivan News

Comment: A case for ?institutional reforms? in the Maldives thumbnail

The January 16 arrest of Criminal Court Chief Justice Abdulla Mohamed, and the subsequent prosecution of former President Mohammed Nasheed and certain senior officials should now indicate the kind of ?institutional reforms? that the Maldives requires.

The current political impasse has had its immediate origins purportedly in the arrest of Judge Abdullah and may continue with subsequent criminal charges facing President Nasheed for his part in the detention. ?Therefore the need for addressing these issues is urgent.

Yet, this should be attempted with the full realisation that Rome cannot be built in a day, as the erstwhile ruling Maldivian Democratic Party (MDP) might have hoped for.

In all fairness, the political crisis leading to the controversial February 7 resignation of President Nasheed did not have its origins in the arrest of Judge Abdullah. Nor would it have been the end-game.

Yet, it purportedly alienated one more section of the Maldivian society, this time the legal fraternity. Some saw it as a diversionary tactic at best when the Nasheed Government was besieged by the political opposition. It gave an additional cause for the ?December 23 movement? of Islamic NGOs to press their demand for President Nasheed?s exit.

The movement from the very beginning had the blessings and participation of the otherwise diverse and at times desperate group of opposition parties in the country. This fact should not be overlooked either.

The arrest of Justice Abdulla by the Maldivian National Defence Force (MNDF), the nation?s armed forces, raises questions. So has the criminal case against President Nasheed and others.

The MNDF was created in 2004 by bifurcating the notorious National Security Service (NSS) under then President Maumoon Abdul Gayoom. This was done precisely with the intention of ending the misuse and abuse of the NSS, which at the time had policing powers, rights and responsibilities, as well. The bifurcation involved the creation of a Maldivian Police Force, which had the policing powers, and the MNDF was made the nation?s armed forces, as in any other country. But old habits did not die either then, or since.

Politicisation of security forces

Justice Abdulla?s arrest, those of two opposition leaders, namely, Abdullah Yameen of the People?s Alliance (PA) and Gasim Ibrahim of the ?Jumhoree Party (JP) in mid-2010, and also a day-long closure of the nation?s Supreme Court all involved the MNDF. ?Though these detentions should have stopped with the police.

Even after bifurcation of the NSS and the emergence of multi-party democracy, in that order, the Government is excessively dependent on the MNDF for law and order duties. At the institutional-level, the MNDF and the MPF have continued to take orders from the government of the day.

At the personal-level, this may have become possible only with top-level transfers with every change of government and change of ministers? loyalty, leading to constant and confusing politicisation of the security forces in the country.

It does not stop there. Apart from President Nasheed and his Defence Minister, the Attorney-General had also named then MNDF chief, Major General Moosa Ali Jaleel, Brigader General Ibrahim Mohamed Didi, heading the troops in the national capital, and Colonel Mohamed Ziyad for the arrest of Justice Abdulla.

They were removed from their positions immediately after the Waheed Government took over. So was then Commissioner of Police of Male.

This was a repeat of the situation when President Nasheed assumed office. In the present case however, Brigader General?Didi had played a key role in defence of Male when Sri Lankan Tamil mercenaries attacked Male in 1988. He was posted back to Addu City in the South after President Nasheed?s resignation, and lost no time in resigning from the armed forces after three-plus decades of service after the government moved the Hulhulumale court?. To the local media, he said that he did not want to compromise the dignity of his office and uniform by appearing as an accused in a civilian court.

Through the past months since President Nasheed resigned from office, the MDP has charged both the MNDF and police with being part of the conspiracy to overthrow his Government along with their political opponents.

Obviously, they have the respective leaderships of these forces at the time in mind. As they are also not tired of pointing out, elements within the two uniformed services had indeed joined the street-protests demanding his resignation since the night before he quit office.

This can demoralise the already demoralised forces. It could cause more problems than solving any, even as the nation is inching towards fresh presidential polls ? either when due in the second half of next year, or earlier, as demanded by the MDP.

The circumstances under which President Nasheed resigned are the subject matter of an independent probe by a Commission of Inquiry (CNI), to which the MDP, as also the Commonwealth have named two members, since.

Pending the inquiry, the MDP has not stopped repeating those charges, or adding fresh ones, particularly with regard to the party?s street-protests to permit or regulate which there are no specific laws in the country. That way, a whole spectrum of legislation needs to be drafted or amended by Parliament, combining the demands of a modern nation with the customs and traditions that have the sanction of law, as elsewhere.

Conflict of interest

Various charges of misconduct and maleficence had been laid against Justice Abdulla prior to his arrest. At present, Presidential Advisor, Dr Hassan Saeed had laid out charges against Justice when he was the Attorney-General under President Gayoom.

The Supreme Court, a creature of the 2008 Constitution, too had occasions to pull him up. So did the Judicial Services Commission (JSC), another controversial institution in which the ruling Maldivian Democratic Party of President Nasheed did not have faith in despite its constitutional character.

Throughout the period of Justice Abdulla?s detention during the Nasheed regime and after his release and resumption of office under the incumbent dispensation of President Mohammed Waheed Hassan Manik, the MDP has claimed that he was a ?threat to national security?. This was at variance with -or, was it in addition to ?the earlier allegations against Justice Abdulla?

If the new charge was true, the MDP Government did not substantiate it. If it were true still, the question arises how a successor Government could take a narrow view of things and order the judge?s release and immediate reinstatement.

The recent report of the Maldivian National Human Rights Commission (NHRC) says that Justice Abdulla had to undergo mental torture and harassment in detention, and efforts also were made to persuade him to leave the country. It ruled out physical torture of any nature, however.

As promised on assuming office, the new Government has since moved the courts, charging President Nasheed, Minister Tholhath and three senior military officials of the time, among others, with unlawful detention of Judge Abdullah. To pre-empt charges of ?conflict of interest? the Government moved the Magistrate Court in suburban Hulhulumale Island, off the national capital of Male, where Justice Abdulla is seated.

However, the magistrate ruled that he could not assume jurisdiction to try the case without Chief Justice Abdulla assigning the same, and the Judicial Services Commission too endorsed it. The Magistrate has not dismissed the petition but has only returned the same to the Prosecutor-General?s office, with the indication for the latter to rectify the process.

It was commendable that the Government had thought about the possibilities of ?conflict of interest? issue being whipped up if Justice Abdulla had tried this case. Yet, judicial systems across the democratic world dictate that such charges are laid by the other party to a criminal case. Better still, in most such cases, the Judge concerned would recuse himself when the situation so demanded.

The short-cut approach adopted by the Government should be seen as a part of the institutional weakness that haunts the process. As such, no motives need to be attributed to the same at this stage, to that limited extent again.

Banishment as a punishment

It is likely that the Government will revive the case against President Nasheed at the appropriate judicial forum. If courts found him guilty, President Nasheed would be barred from contesting elections. Already, the MDP has declared that the party would not participate in any presidential polls where President Nasheed is barred from contesting. Be it as it may, the law relating to the offence for which President Nasheed is being charged with is a fit case for review and reform, it would seem.

The section provides for ?banishment? for a term, or imprisonment for three years, or a fine of Rf 2000. If sentenced to more than 12 months, President Nasheed cannot contest elections until after the completion of three years, or he has been granted a pardon (by the President).

It is very likely that no other democracy, and certainly not in the South Asian region, still has ?banishment? as a part of its penal provisions. In the Maldives, not only banishment but ?house arrest? also continues on the statute book, as a punishment for crimes. Contemporary history is replete with instances where either or both punishments have been freely handed down to political adversaries of the Government, since the pre-democracy days, dating beyond President Gayoom?s 30-year rule.

Other areas of law, like banking, labour all need to be updated. ?The same can be said for legislation outlining migration and property too.

The MDP that has been talking vociferously in favour of fast-tracking legal and judicial reforms has been concentrating mostly on individuals, not necessarily institutions and certainly not processes, which alone add to the value of democracies.

Other parties are not doing that either. They seem to derive comfort from the status quo, not necessarily because they favour it but mostly because the complexities of the social and political issues that such reforms could throw up may be too much for the polity to address. ?Conversely, the reforms process thus far has introduced institutions that are superfluous for a nation of 350,000 people. The number of commissions serving and servicing the Government employees, including the police, is a case in point.

Yet, neither has the credibility of the ?integrity commissions? been ensured, nor have they been allowed to settle down without continued criticism of their functioning.

The MDP calls it ?institutional reforms?, the new Government of President Waheed says there is need for ?institutional empowerment?. In relation to institutions like the higher judiciary, enough time has not been given for either.

The Supreme Court itself is a creature of the new Constitution, and the law provides for a seven-year term for ?capacity-building? in judiciary across the country. No efforts seem to have been made in this regard, nor any attention known to have been given on the kind of reforms or empowerment that is needed, and methods of doing it within the seven-year period.

After the change of leadership, both sides seem to have stopped talking about their respective positions on the issue. The All-Party Roadmap Talks was set up to address such issues, but it has grabbled only with trivial issues, in comparison.

Discussing trivia, instead

There needs to be a greater realisation in all sections of the nation?s policy and society that democracy is not a half-way house, to be built, abandoned, and re-built at whim. It is an evolutionary process, with which individual societies experiment a perceived format and make adjustments and amendments as their nation?s circumstances demanded.

There are no successful models, or failed models in democracies, for an intended democracy to pick off the shelf and display the wares. It has to be meticulously worked upon, brick by brick.

A generation can at best lay strong foundations, but it would be for the future ones to build upon it, brick by brick, floor after one more floor. There would be no finality still, as democracies evolve and need to evolve with the new generation, lest they should be rendered redundant and be described as ?autocracy? of some kind or the other.

That has also been the Maldivian experience, through much of the 20th century. The advent of a new generation, a new century does not make for the experience. It can at best be a cause for experimentation. In all this, a nation?s patience is the key.

It is not that the current crop of leaders in Maldivian polity does not understand. The agenda for the Roadmap Talks that they agreed upon after the change of Government in February focusses on much of what needs to be done.

The prioritisation of the agenda also underscored their understanding of the evolving situation, overall. Yet, on the ground, they are talking politics, not policies. This does not mean that the events leading up to the February 7 resignation of President Nasheed need not be gone into.

It is not about individuals again, but about institutions, including the Presidency and the armed forces, in situations that the Constitution-makers had not provided for but wanted to avoid in the first place. The findings of the CNI could thus form a part of the Roadmap agenda, as much needs to be done on institution-building, all-round, if the new-generation Maldivian dream of democracy has to be nourished and cherished.

Demand For The Next iPhone Is At An ... - Business Insider

The demand for Apple's next iPhone is at an "unprecedented level," according to a new survey from ChangeWave.

The market research firm surveyed more than 4,000 consumers in mid-June and found that 14% said they were very likely to buy the next iPhone and 17% said they were somewhat likely to buy it. In other words, nearly a third of consumers say they will likely buy the fifth generation iPhone.

ChangeWave notes that the demand for the next generation iPhone is "strikingly higher than we've seen for any previous iPhone model." Indeed, a similar survey conducted by the firm last year found that 21.5% of consumers were very likely or somewhat likely to buy the iPhone 4s, well below the demand this year.

A separate survey from Piper Jaffray analyst Gene Munster also found there is enough demand for the next iPhone to make it Apple's best selling phone yet.

Weekly betting title to kick off the football season ? Sports Journalists ...

Search the SJA site

The Telegraph. London 2012. Full interactive guide to all the events at the 2012 Olympic Games

A weekly sports betting newspaper, based in Manchester, is to launch next month.

Called The Bet, the first edition is due out on the first day of the new football season ? Saturday, August 18.

It will be a full-colour 56-page tabloid, priced at ?1 and targeting the ?recreational multi-sport gambler?. The publishers say it will be football-led but cover all televised sport.

The last sports-orientated paper to launch in this country was also a betting-focused title, The Sportsman, in 2006.

A daily rival to the Racing Post, it sought to specialise on football and cricket betting as well as other sports bests ? rather than predominantly horse racing and greyhounds. The publishers went into administration within four months of launch, the title barely reaching half of its circulation target of 40,000.

The Bet?s 10-strong editorial team? is to be headed by former Sun journalist Steve Mullen.? ?We believe there is a very perceptible gap in the market for a specialist multi-sports betting title,? Mark Harris, the company?s MD, said.

With an initial print run of 95,000, The Bet is targeting a 25,000 wekly circulation in Britain and Ireland.

Christopher Nolan: Aurora 'Dark Knight Rises' Shooting 'Senseless'

Christopher Nolan Aurora

Christopher Nolan has spoken out about the horrifying events that took place at a midnight screening of his film, "The Dark Knight Rises."

"Dark Knight Rises" director Christopher Nolan has broken his silence on the shooting that took place at a screening of his film in Aurora, Co. In a statement which Nolan says is on behalf of the cast and crew of the film, the famed director expresses "profound sorrow at the senseless tragedy" and explains that "the movie theatre is my home."

Here's his full statement:

Speaking on behalf of the cast and crew of The Dark Knight Rises, I would like to express our profound sorrow at the senseless tragedy that has befallen the entire Aurora community. I would not presume to know anything about the victims of the shooting but that they were there last night to watch a movie. I believe movies are one of the great American art forms and the shared experience of watching a story unfold on screen is an important and joyful pastime. The movie theatre is my home, and the idea that someone would violate that innocent and hopeful place in such an unbearably savage way is devastating to me. Nothing any of us can say could ever adequately express our feelings for the innocent victims of this appalling crime, but our thoughts are with them and their families.

TV networks announced Friday that they were pulling advertisements for the movie. Warner Bros., the studio behind the film, was reportedly editing the trailer to remove depictions of gun violence.

Auto Insurance Lessons from Seinfeld ? Deductibles and False ...

Puerto Rican flag

Over the course of its nine seasons, NBC?s hit show ?Seinfeld? taught us a lot of useless information. But on occasion, it did teach us a few practical lessons about something we all have to deal with at one point or another: auto insurance. This article is the second installment of a five-part series discussing some of those lessons from the show about nothing.

In one of the show?s last episodes?Episode 176?Jerry?s driving Kramer, George, and Elaine home from a Mets game, which they left early since it looked to be a blowout. On the way home, they get hopelessly stuck in a traffic nightmare brought on by the Puerto Rican Day parade, which becomes an even bigger nightmare when Jerry hears on the radio that the game they just left early is turning out to be one of the biggest comebacks in Mets history. To make things even worse, Jerry?s been boxed in by another driver, whom he?s nicknamed ?Maroon Golf,? who won?t let him out. Kramer thinks he has a solution, which includes a little fibbing to Jerry?s insurance company:

Kramer: You want to get outta here? Here?s what we do. We leave the car here, we take the plates off, we scratch the serial number off the engine block, and we walk away.

Jerry: Walk away?

Kramer: You?ve got insurance. You tell them that the car was stolen, and then you get another one free.

Jerry: Isn?t there a deductible?

Kramer: All right, what is your deductible?

Jerry: I don?t know.

Kramer: Yes, because they?ve already deducted it.

Jerry: From what?

Kramer: The car, which we?re leaving. So the net is zero. See, you pocket the money, if there is any, and you get a new car.

Jerry: We?re not leaving the car!

Kramer: All right. If you refuse to grow up and scam your insurance company, you?ll have to work this out with Maroon Golf.

While Kramer does have his moments of sagacity, he?s giving Jerry some horrible advice here. They haven?t ?already deducted it.? The deductible is the amount you pay on a comprehensive or collision insurance claim before your coverage actually kicks in. So you don?t pay a deductible until after you?ve made a claim. You specify what size deductible you?d like when buying the policy. (There is the option to get a policy with no deductible, but auto insurance quotes for comprehensive coverage are likely to be much higher with no deductible than if you set it at $250, $500, or $1,000.)

And as for leaving the car and reporting it stolen, that?s a crime that can land you in jail. In fact, telling your New York insurance company that you had your car stolen when it really wasn?t is considered a class D felony if the claim is between $3,000 and $50,000. That brings with it a sentence of up to seven years. (If it?s between $1,000 and $3,000, it?s a class E felony, punishable by up to four years in jail.)

Now, back to the episode. Jerry decides to leave the car with George and Kramer to catch the end of the game, but they both also leave the car unattended to do the same. Eventually, a mob starts rioting in the streets, and Jerry?s Saab ends up upside down in a stairwell. The issue of whether the insurance company would cover a car that was vandalized after being left unattended in the middle of the street will have to wait for another article.

Bottom Line: Don?t try to scam your insurance company just so you can catch the end of a ball game. And if your main source of coverage advice is someone like Kramer, get a second opinion.

Acorn Law : Personal injury claimants sought to advise new law firm ...

BROMLEY, England, Jul 19, 2012 (BUSINESS WIRE) ?
A new type of law firm is recruiting personal injury claimants to help
shape the way legal services are delivered to injury victims.

Acorn Law says it will ?put the personal back into personal injury? and
is looking for people to join its advisory panel who can bring their
experiences of making a claim to help make the process better for future
claimants.

The advisory panel will provide insight into the claims process from the
victim?s point of view and will sit alongside other members from the
claims process, including barristers, solicitors and medical
professionals.

?Our solicitors have many years? personal injury experience but we do
not presume to know exactly how it feels to experience the claims
process. Only by understanding the views of those that have been through
a claim, can we deliver a service that is truly designed for the
claimant,? says Acorn?s Chief executive David Green.

The advisory panel will meet twice a year to help design a process that
is responsive to victims? needs. Their first task will be to draft a
Client Charter.

Acorn Law is the first law firm set up in direct response to the
government?s decision to ban referral fees in personal injury cases,
even though the ban will not come into force until April next year. In a
market where the vast majority of law firms pay up to GBP 800 to receive a
case from a claims management company, Acorn Law will neither pay
referral fees nor charge referral fees to business it refers to,
bringing an end to the so-called referral fee merry-go-round.

Former personal injury claimants who are interested in becoming a member
of the Acorn Advisory Panel, should write to the firm, explaining in
less than 350 words what they can bring to the panel, either by email
at: info@acornlaw.co.uk or by
visiting the Acorn Law website at:
www.acornlaw.co.uk

Advisory panel members will sit for two years. Travel costs and other
expenses incurred by attending panel meetings will be reimbursed.
Additionally, each panel member will also receive a donation to a
personal injury charity of their choice at the end of their tenure.

Note to editors:

About Acorn Law

Acorn Law is the first law firm set up in direct response to the
government?s decision to ban referral fees in personal injury cases.

Acorn marks a bold move to put the ?personal? back into personal injury
in a market where the vast majority of law firms pay up to GBP 800 to
receive a case from a claims management company; the firm will not pay
referral fees, nor will it charge referral fees to business it refers
